5.04.010 Definitions.

When used in this title, the following words and phrases shall have the meanings described to them in this section unless otherwise noted.

"Business" means any and all industries, pursuits, occupations, processions and retail and wholesale businesses, except those carried on in a temporary manner by nonprofit organizations as projects for fundraising.

"License" means any business license required by this title except beer and liquor licenses.

"Licensee" means any person to whom a license has been issued under this chapter.

5.04.020 License required.

A. No person shall carry on business within the town without obtaining a town business license, except where that person is specifically exempted from municipal business licenses under the laws of the state.

B. Upon resolution of the town council, the requirements of this chapter may be waived for special occasions as they occur in the town and that such waiver may not be valid for more than three consecutive days. The town council may place any restrictions which is deems desirable in granting the waiver.

5.04.030 Applications.

To apply for a business license, the applicant shall file a completed business license application form with the town clerk. Blank forms shall be available at the office of the town clerk. Payment of a license fee shall precede the issuance of any business license. The information stated in the application shall be true to the best of the applicant's knowledge, and the applicant shall swear and subscribe to this fact before the town clerk, or any officer authorized to take oaths. The application shall state:

A. The name of the applicant;

B. The applicant's place of permanent residence;

C. The applicant's local business address, if any;

D. Description of the business to be licensed and its location.

5.04.040 Granting of licenses.

License applications, together with the license fees, shall be filed with the town clerk. The town clerk may approve the application or it shall be submitted to the town council for consideration. The town council may decline to issue a requested license if its issuance would be detrimental to the public health, welfare and safety or would be in violation of the town zoning ordinance.

5.04.050 Multiple business.

When a person is carrying on two or more different lines of business at a single place of business, he or she shall obtain the most inclusive license of those applicable. When a person is carrying on two or more different lines of business at different places of business, but not more than one line of business at each place of business, he or she shall obtain a separate license for each place of business.

5.04.060 License fees.

The fees for the licenses required by this title shall be as set forth in the table of fees.

5.04.070 Term of licenses.

All licenses shall be issued on a yearly basis and shall begin on the first day of July and shall expire on the thirtieth (30th) day of June.

5.04.080 Licenses issued after beginning of term.

License fees for licenses issued after the beginning of the license term shall be computed pro rata on the basis of the number of months remaining in the term, provided no fee shall be for less than a quarter term.

5.04.090 Prosecutions for violation of this title.

Prosecutions for violation of this title shall be in the town court upon written complaint signed by the mayor.

5.04.100 Violation—Penalty.

Persons violating any provision of this title shall be subject to the general penalty. In addition, a civil judgment for the amount of the license fee due and unpaid may be entered against the defendant.

Chapter 5.08 BUSINESS REGULATIONS

5.08.010 Residential garage sales.

A. When used in this chapter, "garage sale" means a sale, primarily of personal articles and personal household goods and furnishings, from one's place of residence.

B. Residents may join together to conduct a garage sale.

C. Any garage sale shall be completed within a seventy-two (72) hour time frame.

D. Garage sales shall be limited to two sales events per year at any residence.

E. A garage sale does not require a business license.

5.08.020 Flea markets and farmers markets.

A. When used in this chapter, the following words and phrases shall have the meaning ascribed to them in this section:

"Farmers market" means displaying and selling to the general public in the summer season, from a location other than one's residence, produce, flowers, shrubbery and food items, or any combination thereof.

"Flea market" means displaying and selling to the general public, property which was purchased, acquired or gathered principally for resale.

B. License Required. Flea market and farmers market organizers shall obtain a twenty-five dollar ($25.00) business license before the first day of sale. Prior to issuing the license, the organizer shall notify the town of the exact location of the market and specific dates on which the flea market or farmers market will occur. Cleanup of the market area shall occur daily.

C. A flea market shall not exceed three consecutive days.
